These Terms of Service apply to purchases made from WA Split Systems through our website, by telephone, by email, by invoice or in store. By placing an order with us, you agree to these Terms.

1. Products and Services

WA Split Systems supplies split-system air conditioning units, accessories and related products.

Unless installation is expressly included in your written quote, invoice or order confirmation, all purchases are for supply of products only. Installation, electrical works, mounting, pipework, drainage, commissioning and any related services are not included unless specifically stated.

Product images, descriptions, specifications and availability are provided as accurately as possible. Colours, packaging and minor specifications may vary between manufacturers or product batches.

2. Orders and Acceptance

Submitting an order or making payment does not guarantee acceptance of your order.

An order is accepted when WA Split Systems confirms the order in writing, issues an invoice confirming supply, or dispatches the products, whichever occurs first.

We may decline or cancel an order before dispatch where:

  • A product is unavailable or discontinued.
  • A pricing or product description error has occurred.
  • Payment has not been received or cannot be verified.
  • Delivery cannot reasonably be completed to the nominated address.
  • We reasonably suspect fraud, misuse or an unauthorised transaction.

Where we cancel an order after payment has been received and before goods have been supplied, we will provide a refund for the cancelled items.

3. Pricing and Payment

All prices are shown in Australian dollars and include GST unless stated otherwise.

The customer must pay the price shown at checkout or set out in the accepted quote or invoice, together with any applicable delivery, handling or agreed service charges.

Payment must be received in full before products are released or dispatched, unless WA Split Systems has agreed otherwise in writing.

Promotional pricing, discount codes and special offers may be subject to additional conditions and may be withdrawn or changed before an order is accepted.

4. Product Suitability

Customers are responsible for selecting a product that is appropriate for their requirements unless WA Split Systems has expressly provided product selection advice as part of an agreed service.

Air conditioning performance may be affected by factors including room size, ceiling height, insulation, window exposure, building construction, installation quality and environmental conditions.

Where a customer is uncertain about the appropriate system size, installation requirements or compatibility, they should obtain advice from a suitably qualified installer before purchasing.

5. Delivery and Collection

Delivery charges, available delivery areas and expected delivery timeframes will be advised at checkout, in a quote or in the order confirmation.

Delivery timeframes are estimates only and may be affected by stock availability, freight carrier delays, weather events, access restrictions or circumstances outside our reasonable control. We will take reasonable steps to supply products within the advised timeframe.

Customers must provide accurate delivery details and ensure that suitable access is available for delivery of bulky air conditioning equipment.

Where a delivery cannot be completed because of incorrect address details, unsafe or restricted access, or nobody being available where attendance is required, additional delivery charges may apply.

For customer collections, goods must be collected during nominated trading hours and proof of purchase or identification may be required.

6. Inspection on Delivery or Collection

Customers should inspect products as soon as reasonably possible after delivery or collection.

Any visible freight damage, missing items or incorrect products should be reported to WA Split Systems as soon as possible, preferably with photographs of the product and packaging.

This inspection request does not limit any rights available under the Australian Consumer Law.

7. Installation Requirements

Split-system air conditioning products must be installed, connected and commissioned by appropriately licensed or qualified tradespeople where required by law.

WA Split Systems is not responsible for loss, damage, faults, poor performance or safety issues caused by:

  • Incorrect installation or commissioning by a third party.
  • Installation by an unlicensed or unqualified person.
  • Failure to comply with manufacturer instructions.
  • Electrical supply issues, building defects or unsuitable installation locations.
  • Alteration, misuse, neglect or unauthorised repairs.

This clause does not exclude liability where WA Split Systems has provided the installation service or where liability cannot lawfully be excluded.

8. Change of Mind Returns — 30-Day Refund Policy

WA Split Systems offers a 30-day change of mind refund policy for eligible systems purchased from us.

To qualify for a change of mind return:

  • The return request must be made within 30 days of the purchase date.
  • The system must be new, unused, uninstalled and uncommissioned.
  • All indoor and outdoor units, controllers, accessories, manuals and supplied components must be returned complete and undamaged.
  • The goods must be returned in their original packaging, in a condition suitable for transport and resale.
  • Proof of purchase must be provided.

Systems that have been installed, connected, commissioned, used, damaged, altered or returned incomplete are not eligible for a change of mind refund.

For approved change of mind returns, the customer is responsible for arranging and paying the freight cost to return the goods to the nominated WA Split Systems store or warehouse.

Returned goods will be inspected before a refund is approved. Approved refunds will be processed using the original payment method.

This change of mind policy does not apply to faulty products or otherwise limit customer rights under the Australian Consumer Law.

9. Faulty, Damaged or Incorrect Products

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Where a product has a major failure, a customer may be entitled to choose a refund or replacement. Where a product has a minor failure, WA Split Systems may be entitled to provide a repair or other appropriate remedy within a reasonable time.

Customers should contact WA Split Systems with proof of purchase and details of the issue, including photographs or other information reasonably required to assess the claim.

Where a product is confirmed to be faulty or otherwise fails to meet a consumer guarantee, WA Split Systems will comply with its obligations under the Australian Consumer Law, including reimbursement of reasonable return costs where applicable.

WA Split Systems will not require customers to deal only with the manufacturer where WA Split Systems has obligations as the seller under the Australian Consumer Law. (ACCC)

10. Manufacturer Warranties

Some products may include a manufacturer’s warranty in addition to rights available under the Australian Consumer Law.

Manufacturer warranty periods, registration requirements, servicing conditions and exclusions vary by brand and product. Customers should retain their invoice and review the manufacturer’s warranty documentation supplied with the product.

A manufacturer’s warranty operates in addition to, and does not replace or limit, rights under the Australian Consumer Law.

11. Cancellations Before Dispatch

A customer may request cancellation of an order before dispatch by contacting WA Split Systems.

Where goods have not been dispatched or specially ordered, we may approve cancellation and refund the payment made.

Where goods have already been dispatched, the cancellation will be treated as a change of mind return under section 8, unless the goods are faulty or consumer rights apply.

Special-order, custom-ordered or specifically sourced products may not be cancellable for change of mind once ordered from the supplier, unless agreed by WA Split Systems in writing. This does not limit rights relating to faulty or non-compliant goods.

12. Title and Risk

Ownership of products remains with WA Split Systems until payment has been received in full.

Risk in products passes to the customer upon delivery to the nominated delivery address or upon collection by the customer or their nominated carrier.

Nothing in this section limits responsibility for products damaged in transit where WA Split Systems arranged the delivery or where rights arise under the Australian Consumer Law.

13. Limitation of Liability

To the maximum extent permitted by law, WA Split Systems is not liable for indirect or consequential loss arising from delays, incorrect customer information, third-party installation, misuse, unauthorised modification or circumstances outside our reasonable control.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Any liability that may lawfully be limited will be limited to the extent reasonably permitted by applicable law.

14. Website Use

Customers must not use our website:

  • For unlawful, fraudulent or misleading purposes.
  • To interfere with website security or operation.
  • To copy or reproduce website material without permission, except where permitted by law.
  • To submit false, inaccurate or unauthorised order information.

Product content, logos, branding, images and website materials remain the property of WA Split Systems or their respective owners and must not be used without permission.

15. Privacy

Personal information collected through orders, enquiries, deliveries and customer support will be handled in accordance with our Privacy Policy and applicable privacy laws.

Customers are responsible for ensuring that the personal and delivery information they provide is accurate and authorised.

16. Changes to These Terms

WA Split Systems may update these Terms from time to time by publishing revised Terms on its website.

The Terms that apply to an order are the Terms in effect when that order is accepted, unless a change is required by law or agreed with the customer.

We will not apply changes retrospectively in a way that unfairly removes rights or imposes new obligations in relation to an already accepted order.

17. Governing Law

These Terms are governed by the laws of Western Australia and the applicable laws of the Commonwealth of Australia.

The parties submit to the jurisdiction of the courts and tribunals of Western Australia, subject to any rights a customer may have under applicable law.
